Lawsuit against Health referred to mediation

A lawsuit brought against the National Health Services (N.H.S) by Fetunai Saunia has been referred to mediation. 

Mr. Saunia was represented by lawyer Sarona Ponifasio in the Supreme Court yesterday during the Civil mention. 

Appearing on behalf of N.H.S, Sefo Jr. Ainu’u of the Attorney General’s Office asked for an adjournment to file a statement of defense and have the matter refer to mediation. 

Justice Lesatele Rapi Vaai accepted the application. 

Mr. Saunia is suing the N.H.S. for more than $350,000 alleging negligence in the performance of the service which led to the death of his wife, the late Moira Avea Lamese.  

The husband is seeking general damages for loss of dependency, special damages for medical and funeral expenses and estate claim. 

A statement of claim stated that the deceased mother, who was pregnant at the time of her death had a history as an asthmatic patient.
